Trademark and Copyright

Copyright ownership always remains the property of the designer and transfers to the client only where there is an agreement in writing.
Where a specific copyright agreement has not been made between client and designer, the designer effectively gives licence to the client to use the design, only for the specific purpose that it is designed for i.e. for stationery or signage or packaging etc.
If the client wishes to register the logo as a trademark, a copyright agreement in writing must be in place to transfer ownership from designer to client. This Deed of Assignment of Copyright is a legal document.
If the client wishes to include the logo as one of its assets for the sale of a business a deed copyright assignment must be in place to transfer ownership from designer to client.
Payment of charges for a logo design does not imply or give the client unlimited use of this design or artwork and requires permission from the designer to be used in any media.
A separate fee for transferring the copyright ownership will be charged. The ownership of copyright by the client gives the client complete freedom to use - or dispose of - the logo, graphic or digital image at will.
Original artwork including sketches and any other preliminary materials such as computer-aided design prepared by John Wayne Design, remain the property of John Wayne Design unless otherwise specified in writing.
Use of artwork, film, digitally stored data and any other production material without consent of JWD for any purpose other than that which it is intended is an infringement of copyright.

Assignment of copyright to the client can be negotiated and legally transferred in writing.
